Non-Exclusive License to Archive and Openly Distribute Works Submitted to the Florida SouthWestern State College Open-Access Institutional Repository
To properly administrate works archived in, and openly distributed from, Florida SouthWestern State College’s open-access institutional repository, Digital Commons @ FSW (the “Repository”), Florida SouthWestern State College (the “College”) requires certain permissions from you, the copyright owner(s) or appropriate licensee(s) of any work you submit to the Repository (the “Submission”).
By accepting this non-exclusive license to archive and openly distribute your Submission, you do not transfer any copyrights to the College, including your or others’ right to license use of your submission to other publishers, repositories, or end-users.
Unless you declare alternate licensing at the time of submission, by transferring your Submission to the Repository for archiving and distribution, you grant to the College a perpetual, irrevocable, non-exclusive license to copy, store, sublicense, modify (as defined below), and distribute your Submission, including the abstract and metadata, worldwide in any format or medium. You further authorize the College to license end-users of the Repository to copy, store, and distribute worldwide the final published version of your Submission, including the abstract and metadata.
As a condition of this license, the College may, without changing the content, modify your Submission to any medium or format, and store more than one copy for purposes of security, backup, and long-term preservation. At all times, the College will clearly identify your name(s) as the author(s), owner(s), or appropriate licensee(s) of the Submission.
For works archived and distributed under this license, the following statement may appear in the public view of the item record in the Repository:
- "This work is archived and distributed under the repository’s standard copyright and reuse license, available at https://digitalcommons.fsw.edu/copyright.html for this policy. Under this license, end-users may copy, store, and distribute this work without restriction. For questions related to additional reuse of this work, please contact the copyright owner."
As a condition of transferring your Submission to the Repository for archiving and distribution, you represent and warrant that you are the copyright owner(s) or appropriate licensee(s) of the Submission, and that you have the right to grant the rights required by this license. You also represent and warrant that the Submission does not, to the best of your knowledge, infringe upon anyone's copyright. You also represent and warrant that the Submission contains no libelous or other unlawful matter and makes no improper invasion of the privacy of any other person. If the Submission contains material for which you do not hold copyright and that exceeds fair use, you represent that you have obtained the permission of the copyright owner to grant to the College the rights required by this license, and that such third-party owned material is clearly identified and acknowledged within the content of the Submission. Furthermore, you agree to indemnify and hold harmless the Board of Trustees of Florida SouthWestern State College and their officers, fellows, governing board members, employees and agents, from and against all claims, actions, suits, damages, liabilities and costs (including, without limitation, reasonable legal fees) arising from or in connection with the Submission.
